Flare Homes operates an inquiry-based service. We are not a booking platform — you cannot reserve or pay for a stay directly through the Site. Specifically:
- Submitting an inquiry through the Site does not create a booking, reservation, or contract of any kind, and does not guarantee availability.
- Any agreement for accommodation — including price, availability, deposits, house rules, and cancellation terms — is arranged and confirmed directly between you and Flare Homes.
- We do not process, hold, or handle any accommodation payments, deposits, or security deposits through the Site itself. Any such payments are arranged directly with Flare Homes (by phone, email, or WhatsApp, per your inquiry).
3. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. You must not:
- Submit false, misleading, or fraudulent inquiries.
- Attempt to scrape, harvest, or extract data from the Site by automated means without our prior written consent.
- Attempt to gain unauthorized access to any part of the Site or its underlying systems.
- Use the Site to transmit any virus, malware, or harmful code.
4. Property Listings
Flare Homes takes care to publish accurate, up-to-date property information (photos, descriptions, pricing, amenities, and availability) on the Site. That said, availability and pricing can change quickly, so we always reconfirm current details with you directly once you submit an inquiry, before any payment or travel arrangement is finalized.
5. Inquiries and Communication
When you submit an inquiry, our team reviews the details you provide (name, contact information, requested dates, guest count, and any special requests) and responds to you directly with pricing, availability, and next steps, using your preferred contact method. We aim to respond promptly, though response times may vary.
6. Disclaimer of Warranties
The Site and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any property will meet your expectations.
7. Limitation of Liability
To the fullest extent permitted by the laws of Kenya, Flare Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to: (a) your use of, or inability to use, the Site; (b) any property or its condition; (c) any payment, deposit, refund, or cancellation matter relating to your stay; or (d) delays or issues in communication regarding your inquiry or stay. Where liability cannot be excluded by law, our total aggregate liability to you is limited to KES 5,000.
8. Indemnification
You agree to indemnify and hold harmless Flare Homes, its officers, employees, and agents from any claim, demand, loss, or damage, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Site.
9. Intellectual Property
All content on the Site — including text, graphics, logos, and the Flare Homes/Flare Events & Travel branding — is owned by or licensed to Flare Homes and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.
10. Third-Party Links
The Site may link to third-party websites (e.g. maps, social media). We do not control and are not responsible for the content, accuracy, or practices of any third-party website.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
